Earlier today, the United States Citizenship and Immigrations Services (USCIS) released the long-awaited revision of the Form I-9 (Rev. 03/08/13)N. Read the full announcement here. You can download the new form here. All employers are expected to use this new version when completing a Form I-9 for newly-hired employees; or to complete Section 3 for an existing employee who has either been re-hired, has had a change in name, or is presenting an unexpired proof of employment authorization for reverification.

Employers are given a 60-day grace period to fully comply with this requirement and continue using versions (Rev.02/02/09)N and (Rev.08/07/09)Y; however, starting May 8, 2013, all employers, whether using paper forms or electronic systems, are expected to use the (Rev. 03/08/13)N version of the Form or risk fines for non-compliance during an audit.

This announcement comes after a long process of reviews and public comment stages. Ultimately, employers will notice the following key changes on the new Form I-9:

  • Addition of new data fields including the employee's foreign passport information (if applicable), telephone and email addresses;
  • Improvements within the Form's instructions;
  • Revisions in the layout of the Form from one to two pages.

The corresponding Handbook for Employers (M-274) is currently being updated with these changes. The USCIS recommends following the instructions on the new form until the handbook is updated and released to the public.
